How to Choose the Right Trial Consultant

November 25, 2024

You may be wondering just why you need a jury consultant to help you evaluate your case. Jury consulting is a specialized service that aims to strengthen your litigation game. You may have an upcoming trial or a difficult case to settle. If you really want the best results, you can greatly benefit from the expertise of a trial consultant. By determining your case’s strengths and weaknesses from an unbiased perspective, a consultant can save you time while doing all that is possible to ensure quality results.

“Why Should I Hire You?”

One of my main points of focus is to figure out how biases impact your jurors. Consultants typically have a background in psychology, sociology, anthropology, and/or law. We are professionals who can uncover hidden biases by interpreting responses to surveys and analyzing juror behavior, and also by interpreting subliminal messages from both verbal and nonverbal cues.

Pre-trial research using focus groups provides a window into the minds of jurors. We recruit participants according to specific criteria and work with you to craft presentations that will expose case strengths and weaknesses, including often unanticipated factors. Juror biases are revealed as they analyze and discuss your case.

As your consultant, I will help you learn how your case is perceived by likely jurors. It is my job to pinpoint the facts and themes of your case that will carry the most influence. A prime opportunity for testing your refined case is the mock trial. This is an all-day event in which you will have the chance to argue your case in front of jury eligible respondents. Based on the results, I provide feedback to help you make the right choices when the time comes for the real deal.

If you feel that your case is not strong enough, I am more than happy to analyze it and help you to reinforce weak areas. With over 20 years of experience in the field, I can provide a unique perspective on any case and help you carve out a case strategy that is favorable to your client.

A Real Benefit!

With the aid of a jury consultant, you not only get a neutral outlook on your case, you have a highly-trained professional providing you critical insight from your ultimate audience—real people. From pretrial research to witness preparation, each aspect is thoroughly investigated and analyzed for the best possible outcome.

“Use the power of a story.” It’s a piece of advice that attorneys often hear because it furthers your argument and strengthens your case. But what makes storytelling so important to a persuasive legal strategy? Famed neuroscientist Dr. Antonio Damasio of USC found that people with damage to the part of their brain responsible for feeling and processing emotions have tremendous difficulty making decisions, to the point that they may not be able to reach a decision on something as simple as what to have for dinner without extensive deliberation. This shows just how heavy an impact emotion plays on basic decision-making. When crafting your case, you cannot rely on cut-and-dried facts to pull you through litigation. What the most successful trials have in common is a well-developed story to compel the audience. How can you accomplish this?
